Purpose

Welcome to the Olympiasouq website ("the Site"), which includes country-specific sites, mobile apps, blogs, and software sites such as Olympiasouq Rewards. This Terms of Use Agreement ("Agreement") sets forth the terms and conditions for your use of and access to the "Olympiasouq" and "Olympiasouq.com" websites and all associated pages, elements, links, tools, features, and options. By visiting or using Olympiasouq.com, you agree to the terms and conditions of this Agreement, confirming your commitment to comply with this Agreement specific to Olympia Sports ("we"), also referred to as "Olympia" or "Olympiasouq" or .com, concerning your use of the Site, herein referred to as the "Terms of Use" and "Conditions." This Agreement becomes effective upon your acceptance of the terms. Please read this Agreement carefully and thoroughly before using the Site or participating in the Rewards Program or reviews and before disclosing any personal information to us.

By using the Site, participating in the Rewards Program, or reviews, or disclosing any personal information to us, you: (a) agree that you have read and understood the terms of this Agreement, (b) agree to be bound by these terms and accept them, (c) agree to comply with all applicable laws and regulations. If you do not agree with the terms of this Agreement, do not access or use the Site, participate in the Rewards Program or reviews, or disclose any personal information to us.

The terms of use in this Agreement may change periodically, and they may be revised at any time and from time to time at our sole discretion by updating this posting. You should visit this page periodically to review the current terms of use as they are binding on you. Continued use of the Site constitutes acceptance of any changes or modifications to this Agreement. If you disagree with any modifications, your sole remedy is to terminate this Agreement by contacting customer service. Certain provisions of the terms in this Agreement may be superseded by legal notices or terms located on specific pages of the Site.

Risk of Loss/Transfer of Ownership:

All product purchases are made according to the specified Incoterms at the time of each order. Ownership of any products you purchase transfers when we deliver them to the shipping company.

Not Medical Advice

Products and claims about specific products available on or through the Site have not been evaluated by the U.S. Food and Drug Administration and are not approved to diagnose, treat, cure, or prevent any disease.

The Site is not intended to provide diagnosis, treatment, or medical advice. Products, services, information, and other content available on the Site, including that available through direct links to third-party sites, are provided for informational purposes only. Please consult with a physician or healthcare professional before using dietary supplements.

Information provided on the Site and linked sites, including any product label or packaging, should not be considered a substitute for advice from a healthcare professional. Immediately contact a healthcare professional if you have any questions regarding health. Never disregard or delay medical advice based on information you may read on the Site.

Links to third-party websites or access to them do not constitute an endorsement of any information, products, or services. We are not responsible for any content or claims provided by third-party websites. Use of any third-party websites is at your own risk.

You should not use the information or services on the Site to diagnose or treat any health conditions or to prescribe any medication or other treatment. Always consult with a healthcare professional and read the information provided by the manufacturer on the product label or packaging before using any medicinal, nutritional, herbal, or homeopathic product or before beginning any exercise or dietary program. People are different and may react differently to various products. Consult your doctor regarding interactions between the medications you are taking and dietary supplements. Comments made by Site staff or users on any forum on the Site are their personal opinions and do not constitute claims made by us nor represent our positions or opinions. Product reviews from any current or former employees or users of the Site are their opinions only and are not intended as a substitute for appropriate healthcare advice from a healthcare professional. We are not liable for any information provided on the Site concerning recommendations regarding supplements for any health purpose.

Always check the product label or packaging before using any product. If there are discrepancies, the customer should follow the information provided on the product label or packaging. You should contact the manufacturer directly for clarification on the details provided on the product label and packaging and recommended use.

Product Purchases

To the extent that you purchase from the Site, you agree that all product purchases are made according to the specified Incoterms at the time of ordering the products. Ownership of any products you purchase transfers when we deliver them to the shipping company.

Site Use and Termination

By using our Site or participating in any programs, you confirm and agree that you are at least 13 years of age or older, and you can fully comply with the terms, conditions, representations, and warranties stated in this Agreement or the terms and conditions of any programs. If you are under 13, you are not permitted to use this Site or participate in any programs.

You are required to create an account on the Site to use certain features, such as making purchases. You agree to provide accurate, truthful, complete, and current information about yourself as requested by the Site and update this information promptly to maintain its accuracy, truthfulness, completeness, and currency. If you provide any false, inaccurate, incomplete, or outdated information or suspect that such information is false, inaccurate, incomplete, or outdated, we reserve the right to suspend or terminate your account and prevent you from any current or future use of the Site or any part thereof. During the registration process, you will create a username and password. You are responsible for maintaining the confidentiality of your account and password and are fully responsible for all activities that occur under your account or password. You agree to notify us immediately of any unauthorized use of your account or password or any other security breach and ensure that you log out of your account at the end of each session. You also agree that we are not responsible for any loss or damage resulting from your failure to comply with this section.

You agree to use the Site for lawful purposes and are responsible for your use and communications on the Site. You agree not to post or transmit any unlawful material that violates the law, defamatory, obscene, inappropriate, threatening, abusive, or any other material that encourages illegal behavior or conduct that could lead to civil liability or violate others' intellectual property rights or any local, state, national, or international laws. You agree not to use the Site in any manner that interferes with the normal operation of the Site or any other violation of Site use.

You agree not to access the Site other than through the interface provided by us. Displaying or running the Site or any information or materials displayed on the Site in frames or through similar means on another website is prohibited without prior permission from us. Any allowed links on the Site must comply with all applicable laws and regulations.

We do not warrant that the materials on the Site or products described or offered on the Site are appropriate or permitted for use in jurisdictions outside Oman, nor do we suggest that this Agreement complies with the laws of any other country. Site users from outside Oman do so on their initiative and at their own risk and are responsible for ensuring that these materials comply with all applicable laws and regulations. You agree not to access the Site from any location where the Site's content is illegal and acknowledge that you, not us, are responsible for compliance with all applicable laws and regulations.

This Agreement shall remain in effect until terminated by us or you. We may terminate this Agreement at any time at our sole discretion without prior notice and prevent you from accessing the Site or any part thereof. You may terminate this Agreement at any time by contacting customer service and ceasing to use the Site altogether. Upon termination of this Agreement by you or us, you must destroy all materials obtained from the Site, including all copies thereof, whether under these terms of use or not. We reserve the right to modify or discontinue the Site or any part thereof temporarily or permanently and will provide you with notice thereof.

We reserve the right to terminate any account if we deem your order fraudulent or dispute the charges on the credit card. You agree that we may terminate or suspend your access to the Site, in whole or in part, with or without notice, for any conduct we believe, in our sole discretion, violates any part of this Agreement, the law, or regulations, or harms another user or us or our partners.

The following provisions survive the termination of this Agreement, whether terminated by you or us: Privacy, Disclaimer, Severability, and Miscellaneous.

Certain areas of the Site implement Google Maps / Google Earth services. Your use of Google Maps / Google Earth is subject to the Google Maps / Google Earth Additional Terms of Service and Google's Privacy Policy.

User Content and Conduct

Where applicable on the Site, you may post your content ("User Content"). You understand that you are personally responsible for any content you post on the Site. You alone bear all risks associated with your User Content, including reliance on its accuracy, truthfulness, or reliability, or any disclosure of information in your User Content that makes it possible to identify you. You may not imply that your User Content is endorsed by us. We cannot guarantee that your User Content will not be misused by other users. If you have information that you wish to keep confidential and/or do not want others to use, do not post it on the Site. We are not responsible for any User Content, including any errors or omissions, or any loss or damage resulting from the use of any User Content posted on the Site in any manner. We are also not responsible for any user using or exploiting any User Content you post on the Site for personal gain.

By posting User Content on the Site, you grant us (or warrant that the owner of such rights expressly grants us) a perpetual, worldwide, royalty-free, irrevocable, non-exclusive right and license to use, host, store, reproduce, adapt, publish, translate, edit, sublicense, modify, create derivative works from, communicate, display, and distribute such content publicly or otherwise in any manner. You also represent and warrant that the User Content you post does not infringe the privacy rights, publicity rights, property rights, contract rights, or any other rights, including moral rights, of any person.

You understand that we may retain copies of User Content and disclose it if required by law or if we believe in good faith that such retention or disclosure is reasonably necessary to comply with legal processes or enforce this Agreement or respond to claims that such content violates the rights of a third party or protect the rights, property, or personal safety of us, our users, or the public. You also understand that the technical processing and transmission of the Site, including User Content, may require transmission over different networks and changes to conform and adapt to the technical requirements of connecting networks or devices.

We strive to comply with the requirements of the Digital Millennium Copyright Act applicable to service providers. If you believe that any content made available through the Site infringes your copyright, you may contact our designated agent via email at legal@olympiasouq.com.

Please include the following information with your complaint:

• A description of the copyrighted work or other intellectual property that you claim has been infringed.
• A description of the material that you claim is infringing and where it is located on the Site.
• Your email address, mailing address, and phone number.
• A statement from you that you have a good faith belief that the disputed use is not authorized by the copyright owner, its agent, or the law.
• An electronic or physical signature of the copyright owner or a person authorized to act on behalf of the copyright owner.

You agree not to use the Site for the following:

• Posting or transmitting any harmful, false, illegal, obscene, defamatory, or otherwise offensive User Content.
• Harassing, stalking, or otherwise abusing others.
• Impersonating any entity or falsely claiming an affiliation with any person or entity.
• Harming minors.
• Attempting to conceal the origin of any User Content posted on the Site.
• Posting or transmitting any User Content you do not have the right to transmit under any law, contractual, or fiduciary relationship.
• Posting or transmitting any User Content that infringes any patent, proprietary rights, trademark, or other intellectual property rights ("Rights") of any party, or posting or transmitting any protected material on the Site.
• Posting or transmitting any unsolicited advertising, promotional materials, spam, chain letters, or other forms of solicitation.
• Posting or transmitting any User Content containing viruses, Trojan horses, or other harmful or destructive materials that limit the functionality of any computer software or hardware or telecommunications equipment, or interfere with any third party's use of the Site.
• Collecting data about other Site users.
• Accessing areas of the Site to which you are not authorized, including servers or networks.

We will terminate and/or block the accounts of Site users who violate any person's rights on the Site. You understand that by using the Site, you may be exposed to inappropriate or unwanted User Content posted by others. We do not endorse or control such User Content. We do not pre-screen User Content, and it does not reflect our opinions. We make no express or implied representations or warranties regarding the accuracy or reliability of User Content or any other materials or information you may obtain from the Site. We are not responsible for monitoring User Content or improper conduct on the Site. If we choose to monitor the Site at any time and at our discretion, we are still not responsible for any User Content, nor are we responsible for the conduct of Site users who post such content. Nonetheless, we reserve the right to remove any User Content that violates this Agreement or is otherwise deemed unacceptable by us. You agree that you must evaluate and bear all risks associated with using any User Content, including reliance on the accuracy, completeness, or usefulness of such content. You acknowledge that you cannot rely on any User Content. You alone are responsible for your interactions with other Site users. We reserve the right, at our sole discretion and without obligation, to monitor communications between you and other Site users and to terminate your access to the Site.

You agree to indemnify and hold harmless Olympiasouq from all third-party claims, damages, losses, liabilities, or causes of action arising from your posting of any content or materials, or failure to comply with this Agreement. You agree to fully cooperate as reasonably required in the defense of any such claims. We reserve the right, at our expense, to assume exclusive defense and control of any matter otherwise subject to your indemnification. You may not, in any event, settle any matter without prior written consent from Olympiasouq.

We do not review all communications and User Content posted or uploaded by users to interactive areas on the Site, nor can we do so. We are not responsible for any content of these communications or materials posted or uploaded to the Site. We reserve the right to block, move, remove, or edit any part or all of any content you submit to the Site that we find, at our discretion, to be fraudulent, misleading, deceptive, offensive, obscene, defamatory, infringing on proprietary or trademark rights, or otherwise unacceptable to us. Any content posted on interactive areas of the Site should not be construed as medical or professional advice or instructions.

Privacy

Your privacy and security are top priorities at Olympiasouq. Please review Olympiasouq's Privacy Policy, which applies to the personal information we collect from you or that you provide on the Site.

Software

Your participation in the programs is voluntary and remains in effect until terminated by you or Olympiasouq.

OLYMPIA FITNESS Rewards Program

Rewards Program Period

The Rewards Program is ongoing and will continue until terminated following the terms and conditions outlined herein ("Rewards Program Period").

Eligibility

The Rewards Program is available only to Olympiasouq customers aged 13 or older at the time of participation. The Rewards Program is void where prohibited or restricted by law. Your participation in the Rewards Program and use of the Rewards Code or Rewards Link constitutes your full and unconditional acceptance of all these terms and conditions and the decisions and interpretations of Olympiasouq, which are final and binding in all respects concerning the Rewards Program.

General Information About the Rewards Program

Subject to the eligibility requirements outlined above, you can participate in the Rewards Program when you purchase products available for sale on the Olympiasouq website or apps. When you complete your first order, you will participate in the Rewards Program and be considered a Rewards Program participant to earn credit for future purchases on Olympiasouq ("Rewards Credit").

The Rewards Credit you earn under this Rewards Program can only be used for future purchases on Olympiasouq or the Olympiasouq app and cannot be redeemed for cash.

When you participate in the program, you will receive a unique link ("Rewards Link") and a special code ("Rewards Code"). Both the Rewards Link and Rewards Code will be linked to the participant's account.

You will earn Rewards Credit for orders placed by new and existing customers you refer to Olympiasouq using the Rewards Code or Rewards Link ("Referred Customer").

To refer using the Rewards Link, you can:

• Go to your favorite product or category page, or create a shopping cart with your favorite products. Then click the share button in the top left corner to share your unique Rewards Link.
• Go to your Order History and click the share button for each order to share it with others.
  You can share your Rewards Code by advising potential Referred Customers to use your Rewards Code in their shopping cart.

When the Referred Customer places an order through your Rewards Link or provides us with your Rewards Code, and after that order is completed, shipped, and paid for, you will receive Rewards Credit for these orders, which will be sent to your account following the Rewards Program Accounting and Payment Information section below.

You can earn (a) 5% Rewards Credit on any order placed by the Referred Customer for products sold on the Olympiasouq website, (b) 2% Rewards Credit on any order placed by the Referred Customer for products from the Olympiasouq company, (c) or an additional percentage of Rewards Credit if Olympiasouq, in its sole discretion, decides to run a special promotional program from time to time.

Your Rewards Credit will automatically be used on future orders and appear in your shopping cart when logged into your Olympiasouq account. Rewards Credit can only be used as credit to purchase products and cannot be used to pay for shipping costs, sales taxes, or other similar fees.

Subject to the limitations below, there is no limit on the amount of Rewards Credit you can earn. However, only one account per person and up to five (5) customer accounts per household can participate in this Rewards Program.

Olympiasouq will track eligible orders under this Rewards Program and may make these tracked orders available to you for up to three months.

To identify the participant who will receive the Rewards Credit for each Referred Customer's order, Olympiasouq will consider the last used Rewards Link or Rewards Code at the time of the Referred Customer's order completion.

Rewards Program Accounting and Payment Information

The percentage calculation for the actual Rewards Credit will be based on the total net purchase price of the products ordered by the Referred Customer.

Rewards Credit will generally be sent to your account within 30 days of the applicable transaction completed by the Referred Customer ("Pending Credit").

After the 30 days referred to above, the Pending Credit will become available in your account and be used for future purchases ("Available Credit"). The Available Credit expires 180 days after it becomes available in your account.

When the Available Credit is used, the amount will be deducted from your account ("Used Credit").

Any Pending Credit or Available Credit may be adjusted if the Referred Customer subsequently returns or refuses a previous order ("Cancelled Credit").

General Restrictions on the Rewards Program

Olympiasouq reserves the right to void Rewards Credit if found to have been improperly credited to your account, obtained fraudulently, or obtained in violation of these terms and conditions.

Rewards Credit is not considered property and does not give you a vested right or interest, has no monetary value, and cannot be exchanged for cash, sold, or transferred for any reason.

All accounts must be in the name of a living individual, not a business entity.

Olympiasouq is not responsible for any discrepancies, delays, deletions, inconsistencies, or errors in the account or the Rewards Credit calculation. Decisions made by Olympiasouq regarding the Rewards Program, including, but not limited to: eligible purchases, earned credits, account balances, and Rewards Credits, are final, binding, and not subject to challenge in all respects.

If you create multiple accounts or attempt to participate in the Rewards Program using multiple identities, Olympiasouq, at its sole discretion, may disqualify you and cancel all such accounts. Rewards Credit from different promotional offers cannot be combined for any purpose.

Olympiasouq reserves the right to cancel any orders on our website or apps under this Agreement.

You may not engage in any form of commercial advertising, as the Rewards Program is not intended for commercial purposes. Using Rewards Codes on commercial websites (including but not limited to deal or coupon websites, eBay, Amazon, etc.) is strictly prohibited and will result in the suspension or banning of your account and any credit contained within it.

You are also prohibited from engaging in any form of cross-referral abuse that aims to misuse and disrupt the normal operation of the Rewards Program.

General Promotional Restrictions

You may share your Olympiasouq reviews or "My Page on Olympiasouq" and your Rewards Code on your blog and social media accounts (such as Facebook, Twitter, and Google+) per the terms and conditions of these accounts. However, your social media account must not include an avatar or other content that may be interpreted as being operated by Olympiasouq. Additionally, your username must not include the word "Olympiasouq." You are prohibited from posting your Rewards Code on Olympiasouq's official social media accounts or the Olympiasouq website (reviews and Q&A sections, My Page on Olympiasouq, etc.) to earn Rewards Credit.

Your blog, website, or social media pages must not resemble Olympiasouq's website or include content suggesting an affiliation with Olympiasouq.

You may email your Rewards Code using your email or the email icon on the Olympiasouq website. However, these emails must not appear to be sent or endorsed by Olympiasouq. You represent and warrant that you will not engage in and/or facilitate the sending of unsolicited commercial emails (spam).

You may not purchase or use a domain name or subdomain that includes the word "Olympiasouq" or a variation thereof or a misspelling thereof in any username or group name or identifier on social media.

You may not create or use a client-side application (browser plugins, extensions, executables, etc., that an end user can install) in any manner that may suggest an affiliation with Olympiasouq. Furthermore, to the extent that you create an application, such applications may not be integrated and/or used with Olympiasouq's app in any manner.

Additional Promotional Restrictions:

• Promotional activities must not contain content promoting violence, defamatory material, obscene material, or content promoting illegal activity.
• You may not link to or associate with any content other than Olympiasouq or redirect traffic to other websites (some portions of your website that do not promote Olympiasouq products may contain links to other sites).
• You may not modify any material or add misleading information that may mislead customers.
• You must promptly delete items no longer advertised on Olympiasouq or sold on the Site.
• You may not use names or likenesses in any manner that suggests endorsement or sponsorship by any person, company, or trade association (including the placement of unrelated materials near the content) with Olympiasouq.
• You may not place, display, or use links or other content on your website containing or related to malicious or harmful code, or any software authorized without users' explicit knowledge before downloading.
• You may not attempt to redirect or intercept traffic from any website participating in the Rewards Program.
• You may not integrate Olympiasouq into a web view or embed it in an in-app browser display.
• Interstitials, pop-ups, and/or framing of the Site are not allowed for promotional activities.
• Artificially generating clicks or impressions to create sessions on Olympiasouq is prohibited, whether using software or otherwise.
• You may not use your Rewards Code to earn Rewards Credit from your purchases, nor may you use it for any commercial resale purposes.
• All "paid search" or redirection links are prohibited and may result in the suspension of the Rewards Program associated with your account, and any Rewards Credit earned from such activity will be void. For these terms and conditions, "paid search" means advertisements purchased through bidding on keywords, search terms, or other participation in a keyword auction such as Google, Yahoo, Bing, Yandex, Baidu, Naver, or any other search engine or paid advertising service, or any search or referral services or any site participating in any of their networks.

Account Confirmation

All accounts, eligible purchases, and/or Rewards Credits are subject to confirmation at the discretion of Olympiasouq. Olympiasouq reserves the right to cancel Rewards Credits and suspend/ban your account from any IP address or device if any fraudulent or suspicious activity is detected or suspected.

Rewards Credits are invalid if associated with an account deemed void due to any violation of the terms outlined in these terms and conditions.

Olympiasouq will notify you via email if your Rewards Credits are canceled and/or your account is suspended/banned.

Any abuse of the Rewards Program will result in the immediate cancellation and forfeiture of all Rewards Credits earned.

Termination of the Rewards Program

In the event of the termination of the Rewards Program, we must issue you Rewards Credit at Olympiasouq's sole discretion as Rewards Credit to use for purchases from Olympiasouq. Our obligation is limited to a maximum of three months of Rewards Credits, calculated based on the Rewards Credits of the month preceding the termination of the Rewards Program.

Olympiasouq may change its policy or impose limits and restrictions on the Rewards Program at any time without prior notice. Except as expressly provided above, Olympiasouq assumes no responsibility or liability concerning the implementation of the Rewards Program, and any decision made by Olympiasouq regarding your Rewards Credit is final.

Disclaimer

You agree that your use of the Site or participation in any programs is at your own risk. The Site, programs, and materials are provided on an "as is" and "as available" basis, except as expressly provided otherwise in this Agreement. Olympiasouq and other affiliated companies, its employees, directors, and other representatives, heirs, and agents (collectively "Olympiasouq Entities") expressly disclaim all warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

Olympiasouq Entities do not make any warranties that the Site or any of the programs will meet your requirements, that the Site will be uninterrupted, secure, or error-free, or that the results obtained from the Site or any of the programs will be accurate or reliable, or that the quality of any products, services, information, or other materials obtained through the Site will meet your expectations and any errors on the Site will be corrected. Downloading any material or otherwise obtaining it through the Site or any program is at your own risk, and you are solely responsible for any damage to your computer system or loss of data resulting from the download of any material. No information you obtain from Olympiasouq Entities through the Site or any program will create any warranties related to the Site or the program not expressly stated in this Agreement.

To the fullest extent permitted by applicable law, Olympiasouq Entities disclaim any warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose concerning products and services listed or purchased from the Site, and your participation in any of the programs. Without limiting the generality of the foregoing and to the fullest extent permitted by applicable law, Olympiasouq Entities expressly disclaim any liability for defects or failures in products, claims related to ordinary wear and tear, product misuse, modification, abuse, or incorrect product selection and failure to follow printed instructions.

To the fullest extent permitted by applicable law, Olympiasouq Entities shall not be liable for any indirect, incidental, special, or consequential damages (including damages for loss of business, loss of profits, loss of goodwill, loss of use, loss of data, cost of procurement of substitute goods or services, litigation, or similar), whether based on breach of contract, breach of warranty, tort (including negligence), product liability, or otherwise, even if Olympiasouq Entities have been advised of the possibility of such damages. The liability limitations set forth herein are fundamental elements of the basis of the arrangement between you and Olympiasouq. The products, information, programs, and services offered through the Site would not be provided without these limitations. Accordingly, to the fullest extent permitted by applicable law: (a) if you are a customer, the maximum liability of Olympiasouq Entities shall be limited to the amount paid for any product or information or service purchased from Olympiasouq on the Site; (b) if you are a participant in any of the programs, the maximum liability of Olympiasouq Entities shall be limited to the amount spent or paid to you by Olympiasouq under the applicable program within the 12 months before the scheduled date of the claim.

Since some states and/or jurisdictions do not allow the exclusion of certain warranties or limitations or exclusions of liability for certain types of damages, some of the above disclaimers and limitations may not apply to you. If you are dissatisfied with any part of the Site or participation in any programs, your sole and exclusive remedy is to stop using the Site or stop participating in the applicable program.

We make no representations or warranties regarding any products or services we sell. We are also not liable for any damages arising from information or products or services provided by a third party, even if we have been advised of the possibility of such damages.

Indemnification:

You agree to indemnify, defend, and hold harmless Olympiasouq from and against all losses, expenses, costs, and damages, including reasonable attorney's fees, arising out of your use or communications on the Site or participation in any program, your use or inability to use the Site or services, any products or services you purchase or obtain in connection with the Site, any postings on the Site or activities related to your account by you or another person, your violation of any of the terms of this Agreement, your violation of any third party rights, or your violation of any applicable laws or regulations. You agree to cooperate fully as reasonably required in the defense of any such claims. We reserve the exclusive right to assume the defense and control of any matter subject to your indemnification, in which case you agree to indemnify us for attorney's fees and expenses and any losses, claims, damages, or liabilities incurred by us. You may not settle any matter without prior written notice from Olympiasouq.

Intellectual Property, Trademarks, and Other Intellectual Property Rights

We acknowledge that all materials on the Site or provided concerning the programs, including the Site's design, text, graphics, sounds, images, software, and other files and the selection and arrangement thereof (collectively "Materials"), are our property and are subject to and protected by copyright and other intellectual property rights under Omani and international copyright laws. The trademarks, service marks, trade names, logos (collectively "Marks") on the Site, including but not limited to Olympiasouq, are the exclusive property of Olympia Sports. All page headers, custom graphics, and icons are trademarks of Olympiasouq. You are granted a limited, non-exclusive, non-transferable, non-sublicensable, revocable license to access and use the Materials and Marks solely in a manner permitted by Olympiasouq for your personal and non-commercial use only ("License"). The License remains in effect until this Agreement is terminated by you or us under this Agreement. Any unauthorized use of the Materials and Marks is grounds for terminating the License. All rights not expressly granted herein are reserved by Olympiasouq and its licensors. Intellectual property rights, trademarks, product names, company names, logos, and other intellectual property rights are the property of their respective owners, with all rights reserved.

Agreement:

This Agreement constitutes the sole agreement between us and you concerning the subject matter of this Agreement. This Agreement supersedes all concurrent written or oral agreements, representations, warranties, and understandings concerning the subject matter of this Agreement.

Severability; Performance

If any provision of this Agreement is deemed void or unlawful or unenforceable for any reason, that provision shall be excluded from this Agreement, and the remaining provisions shall remain in effect. The phrase "including" in this Agreement is considered followed by the words "without limitation."

Applicable Law, Jurisdiction, Dispute Resolution, and Waiver of Class Action

All questions concerning the formation, validity, execution, interpretation, and enforcement of this Agreement shall be governed by local law without regard to its conflicts of law provisions.

To the fullest extent permitted by law, you and the Olympiasouq Entities agree to arbitrate any dispute, claim, or controversy arising from or relating to this Agreement, including, without limitation, claims based on contract, tort, negligence, statutory or regulatory provisions. Each party waives its right to litigate in court and to have any dispute, claim, or controversy heard before a judge or jury.

You and the Olympiasouq Entities expressly agree to arbitrate any dispute, claim, or controversy arising from or relating to this Agreement in any way. This Agreement also applies to the arbitration of all disputes, including those regarding the enforceability or illusory nature of the agreement and any defenses to arbitration. You also agree that any arbitration will be conducted on an individual basis, not as a class or class action, or any other type of representative proceeding. The arbitrator shall not consolidate more than one person's claims and shall not otherwise preside over any form of representative or collective action.

The mutual promise between you and the Olympiasouq Entities to arbitrate all disputes and to do so on an individual basis instead of in court or before other forums is a mutual consideration for this arbitration agreement.

Either party may exercise its right to arbitration by providing written notice to the other party of all claims that form the basis of such rights with sufficient detail to inform the other party of the substance of such claims. Under no circumstances may any arbitration demand be filed after the applicable statute of limitations bars the bringing of a claim or cause of action.

Unless otherwise agreed by you and the Olympiasouq Entities, arbitration will be conducted in the county where you reside before a single neutral arbitrator and under the current rules for resolving disputes of the Omani Arbitration Association. Each party shall have the right to be represented by an attorney or other representative of their choosing. The parties agree to abide by and perform any award rendered by the arbitrator. The arbitrator's award shall be written and shall contain the essential findings and conclusions on which the award is based. The award may be entered into any court of competent jurisdiction.

All payments for filing, administration, and arbitrator fees shall be governed by the Omani Arbitration Association's rules.

Miscellaneous:

You may not assign this Agreement by operation of law or otherwise without our prior written consent. Subject to this restriction, this Agreement shall be binding on and inure to the benefit of the parties, their heirs, and agents and be enforceable against them.

Olympiasouq's failure to enforce strict adherence to any provision of this Agreement shall not constitute a waiver of that provision, nor shall it be considered a waiver or limitation of that party's right to enforce strict adherence to that provision or any other provision of this Agreement thereafter. Regardless of any statute or law, you agree that any claim or cause of action arising out of or related to the use of the Site or this Agreement must be filed within one (1) year after such claim or cause of action arose or be forever barred. The "Disclaimer" provisions of this Agreement are for the benefit of the Olympiasouq Entities as defined herein, and each of them shall have the right to enforce and enforce these provisions directly against you on its behalf.
